Maxlivin Bio Sdn Bhd (1419814-A) is an E-Commerce company registered and operating in Malaysia.

By choosing to become a Normal Member of MAXLIVIN’, you hereby declare that you are doing this out of your own will without any undue influence or duress and agree to be governed by MAXLIVIN’ Terms & Conditions.

These Policies and Procedures Guide ("Policies"), in their present form and as amended by Maxlivin Bio Sdn Bhd (hereafter " MAXLIVIN’ or the "Company"), are incorporated into the Terms & Conditions (the "Agreement").

Agreement

1. Understanding and Incorporation

Throughout these Policies, when the term "Agreement" is used, it refers to MAXLIVIN’ Normal Member Terms & Conditions and Policies. These documents are incorporated by reference into MAXLIVIN’ Terms & Conditions (all in their current form and as amended from time to time by MAXLIVIN’). It is the responsibility of each MAXLIVIN’ Normal Member to read, understand, abide by, and ensure that he or she is aware of the most current version of these Policies.

2. Amendments

MAXLIVIN’ reserves the right to amend the Agreement and its prices at its sole and absolute discretion. By signing the Agreement, the MAXLIVIN’ Normal Member agrees to abide by all amendments or modifications that MAXLIVIN’ elects to make. Amendments shall be effective upon written notice to all Normal Members that the Agreement has been amended. Notifications of amendments shall be published in official MAXLIVIN’ materials. The company shall provide or make available to all MAXLIVIN’ Normal Members a complete copy of the amended provisions by one or more of the following methods:

  • Posting on the Company's official website;
  • Electronic mail (e-mail);
  • Inclusion in Company's periodicals
  • Inclusion in product orders; or

3. Registration Process

To become a MAXLIVIN’ Normal Member, each applicant must comply with the following:

  • Submit a completed application form;
  • Be of legal age of 18 years old; and
  • Reside in Malaysia or any country where MAXLIVIN’ has officially announced that it is open for business.

4. Date of Acceptance

An applicant becomes an approved MAXLIVIN’ Normal Member on the date of signing up for his/her membership. By signing up for the account, it is deemed the Member has accepted the terms and conditions of this Agreement.

5. Submission of Incorrect or invalid Information

An incomplete, incorrect, or fraudulent Agreement in any aspect will be invalid and of no force or effect. The Normal Member may only apply or enroll in the country of their permanent residence. An applicant is prohibited from submitting any false or inaccurate information to the Company. The Company expressly reserves all rights to terminate the Agreement and declare it void from its inception if the Company determines any fault with the information submitted by the Normal Member. dThe Company reserves the right to request supporting documents from the Member and failure to comply may result in the Company declaring said Agreement void.

6. Fees

The company or its third-party administrator may charge fees for various services it provides, including fees for product shipping charges.

Purchasing Products

7. Process

  • All orders must be accompanied by proper payment, including all applicable shipping or handling fees and sales tax; and
  • An order transaction is considered complete only when the order has been paid for and the shipping or delivery method has been fulfilled. If these conditions are not met from the date of order, the Company reserves the right to determine the outcome of the order at its sole discretion, and the ordering Normal Member releases MAXLIVIN’ from any further obligation or liability.
General Information

8. Corporate Office Visit Policy

Normal Members may visit the Company's offices only at designated times. Normal members MUST make an appointment in advance to arrange such a visit.

Company Refund Policy And Errors And Omissions

9. Force Majeure

Neither party shall be in breach of this Agreement nor liable for delay in performing, or failure to perform, any of its obligations under this Agreement if such delay or failure results from events, circumstances or causes beyond its reasonable control. In such circumstances, the affected party shall be entitled to a reasonable extension of the time for performing such obligations.

10. Change of Address, Telephone, and E-mail Addresses

To ensure timely delivery of products, support materials, and commission cheques, it is critically important that the address, email and mobile number are updated regularly in the Normal Member’s account. MAXLIVIN’ shall not be held responsible if the products are not delivered if the address provided is incorrect or outdated.

Compliance

11. Governing Law

This Agreement shall be governed by and construed by the laws of Malaysia (without regard to conflict of law principles), and the Normal Members hereby submit to the exclusive jurisdiction of the courts of Malaysia.

12. Amended Provision Guidelines

If any provision of the Agreement, in its current form or as may be amended, is found to be invalid, or unenforceable for any reason, only the invalid portion(s) of the provision shall be severed, and the remaining terms and provisions shall remain in full force and effect and shall be construed as if such invalid or unenforceable provision never comprised a part of the Agreement.

Disciplinary Actions

13. If a Normal Member violates any of the Policies, the Agreement, or engages in any illegal, or unethical business conduct involving the use of MAXLIVIN’ products without the consent of MAXLIVIN’, the Company may exercise its rights to invoke disciplinary action the Company deem appropriate. Among the potential disciplinary actions are:

  • Issuance of a written warning or admonition;
  • Termination of your Agreement.
Enrolment Agreement

Hereby I agree to these terms and conditions (which superseded all earlier Terms & Conditions of Normal Member) for each MAXLIVIN’ membership in which I may from time to time be enrolled as a Normal Member.
